Terms of Service

1. Who you are contracting with

The BenchSight service is operated by A.I. Esquire, Inc. ("BenchSight", "we", "us"), trading as BenchSight. By creating a BenchSight account or otherwise using the service, you ("you", "user") agree to these Terms. If you do not agree, do not use the service. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Not legal advice

BenchSight provides analytics and reference information about judges, attorneys, and case outcomes. The service is not legal advice and is not a substitute for professional judgment. You remain solely responsible for your legal strategy and representation of clients.

3. Data accuracy

We label every statistic with its sample size and source. Federal data derives from CourtListener. State-court data is crowdsourced from attorneys and clearly marked as such. Demo seed data is labelled "DEMO DATA." We make no warranty of accuracy or completeness, and disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.

4. Acceptable use

You must not, and must not permit any third party to:

  • use the service for any unlawful purpose or in violation of any law;
  • submit fraudulent or knowingly false case outcomes, or misrepresent your bar credentials;
  • upload personally identifying information about parties, clients, witnesses, or minors when contributing case outcomes;
  • attempt to probe, scan, scrape, reverse engineer, decompile, or otherwise interfere with the security or integrity of the service;
  • resell, redistribute, or sublicense the service or its data to third parties;
  • use the service to send spam, malware, or otherwise abuse other users.

5. Contributions

When you contribute case outcomes, you grant BenchSight a perpetual, non-exclusive, worldwide, royalty-free licence to host, store, aggregate, and display the data anonymously as part of the service. You retain visibility into your own raw entries; other users see only aggregated, anonymised statistics.

6. Intellectual property

BenchSight, including the software, database structure, brand, logo, generated brief layouts, statistical models, and all related documentation, is owned by A.I. Esquire, Inc. or its licensors, and is protected by copyright, trademark, and other intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the service for your own legitimate professional use within the plan you have selected. No other rights are granted by implication.

7. Pricing, billing, and Merchant of Record

Pricing is $99/month for Solo and $149 per attorney per month for Small Firm, following a 14-day free trial during which no payment is required. We will not enrol a paid plan automatically until you provide payment. Subscriptions renew on a monthly basis until cancelled.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, currency conversion, invoicing, cancellation, and refund mechanics are governed by the Paddle Buyer Terms. You may cancel your subscription at any time from your account; cancellation stops future renewals but does not, by itself, generate a refund — see our Refund Policy.

8. Limitation of liability

To the fullest extent permitted by law, BenchSight, A.I. Esquire, Inc., its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, adverse case outcomes, missed deadlines, or strategic decisions made in reliance on BenchSight statistics. Total aggregate liability for any claim arising from your use of the service shall not exceed the fees you paid to BenchSight in the twelve months preceding the claim, or USD $100, whichever is greater. Nothing in these Terms excludes or limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

You acknowledge that statistics surfaced by BenchSight are descriptive, not predictive. Past judicial behaviour does not guarantee future rulings. Sample sizes, source labels, and the explicit "insufficient data" markers are provided so that you can evaluate confidence in any displayed number — you agree to exercise that professional judgment yourself.

9. Suspension and termination

You may cancel at any time. We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk (including misrepresentation of bar credentials or submission of fraudulent contributions), or repeated or serious policy violations. On termination, we will delete your account data in accordance with our Privacy Notice; you remain liable for any unpaid fees accrued before termination.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The state and federal courts located in Delaware shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the service, except that either party may seek injunctive relief in any court of competent jurisdiction.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will update the "Last updated" date and, where appropriate, notify you by email or in-app message. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
